Legal basis and purposes for the processing of your personal data
We process the personal data which you provide to us in the context of using the digital check-in or check-out on our website. Your data is processed exclusively for documentation purposes and to fulfil the obligations arising from a contract that we have concluded with you or with your employer.
In this context, we process the following personal data:
- First and last name
- Business telephone number
- Log data (logins and logouts: date, time, IP address)
- Communication data (message content, feedback)
The legal basis for the processing of your personal data is Art. 6 para. 1 p. 1 lit. b GDPR. The necessity of processing your personal data lies in the fulfilment of obligations arising from a concluded contract with you.
Furthermore, it may be necessary to process your personal data in order to protect legitimate interests (Art. 6 para. 1 p. 1 lit. f GDPR). The legitimate interests are the conclusion or implementation of contracts and other business relationships with our business partners for whom you may be acting as a representative or as an employee. Moreover, legitimate interests include internal administrative purposes (e.g., for accounting) or ensuring IT security and operation as well as for carrying out compliance investigations, ensuring building and plant security or asserting, exercising or defending legal claims.
Recipient of your personal data
In principle, your data will not be transferred to third parties, unless it is intended to be transferred, or if you have expressly consented to the transfer beforehand or if we are obliged or entitled to do so by law. In some cases, it may be necessary to transfer the collected data to other companies within the wpd group. The data transfer is based on our legitimate interest pursuant to Art. 6 para. 1 p. 1 lit. f GDPR.
Your personal data may be processed by processors on our behalf, such as the DrehPunkt GmbH. These are carefully selected in each case and are also audited by us and contractually obligated in accordance with Art. 28 GDPR.
In general, your data will not be transferred outside the EU or the EEA.
Storage period
The personal data will be retained for as long as it is necessary to fulfil the above-mentioned purposes or as long as there are legal or contractual retention obligations.
Rights of the data subject
Data subjects have the right to obtain information from the controller about the personal data concerning them, as well as the right to have inaccurate data corrected or to have it deleted, provided that one of the grounds set out in Art. 17 GDPR applies, e.g., if the data is no longer needed for the purposes pursued. There is also the right to restriction of processing if one of the conditions listed in Art. 18 GDPR applies and, in the cases of Art. 20 GDPR, the right to data portability. If data is collected on the basis of Art. 6 para. 1 p. 1 lit. e (data processing for the performance of official duties or for the protection of the public interest) or lit. f (data processing for the protection of legitimate interests), the data subject has the right to object to the processing at any time for reasons arising from his or her particular situation. We will then no longer process the personal data unless there are demonstrably compelling legitimate reasons for the processing which override the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.
Any data subject has the right to lodge a complaint with a supervisory authority if he or she considers that the processing of data relating to him or her infringes data protection law. The right of appeal may in particular be exercised before a supervisory authority in the EU Member State of the data subject’s residence or of the place of the alleged infringement. In principle, your data will be processed by the controller in Taiwan and not be transferred to third parties. However, in some cases, it may be necessary to transfer the collected data to other companies within the wpd group, including those located outside Taiwan. In such cases, we will take appropriate measures to protect your data.
Your personal data will also be processed by processors that are engaged by us to process personal data on our behalf, such as the wpd windmanager GmbH & Co. KG and the DrehPunkt GmbH. Some of the processors may be located outside Taiwan, such as in the European Union. We will properly supervise the processors.
